Description: On September 14, 2013, plaintiff was lawfully present on W. 119th Street, New York, NY. Defendant Kucyk, in plain-clothing at that time, approached plaintiff and demanded identification. Defendant Velez, also plain-clothed, punched plaintiff in the face when he tried to remove his hands from his pockets while attempting to obtain his identification. Other defendant officers then physically seized plaintiff, who was again punched in the face. Plaintiff was arrested on false charges and transported to the 28th Precinct, then to Manhattan Central Booking, and imprisoned until his arraignment the following day.
