Description: On June 10, 2010, two assailants tried to rob plaintiff. Plaintiff tried to defend himself with a box knife, but the assailants beat him unconscious and slashed his face. The defendants did not believe the plaintiff was a victim of attempted robbery and instead believed he was the attacker. Because plaintiff was not believed to be a victim, he was unable to seek payment for medical procedures from the Crime Victims Compensation Fund. Further, defendant presented a cross complaint against plaintiff for second degree assault and the case was presented to the grand jury without notice.
