Description: On February 19, 1996, plaintiff was involved in a physical altercation with Vance. Plaintiff removed himself from the altercation; however, a man shot and killed Vance moments later. At trial, the government argued that plaintiff acted alone and that he came back to the scene and shot the victim. Detectives Michael Gaughan and James Tierney obtained information establishing the innocence of plaintiff, but failed to disclose it. Further, Assistant District Attorney William Racolin possessed information that established the innocence of plaintiff, but intentionally withheld that information from the Grand Jury, trial court, trial jury, and defense counsel.
