Description: On March 9, 2019, Plaintiff was stopped and apprehended by Sergeant Stanley Lopez, simultaneously asking "Where is the joint?" Plaintiff said he knew nothing about a joint, however, Sergeant Lopez started yelling and Officer Delamota, who also approached, demanded for a joint as well. Officer Delamota then sprayed pepper spray in Plaintiff's eyes. Both Officers then grabbed the Plaintiff and threw him to the ground, holding him down and handcuffing him. Defendants then prepared a false report stating that the Plaintiff had resisted arrest and had possessed marijuana and began a prosecution predicated on manufactured evidence.
