Complaint
Description: On October 6, 1996, Plaintiff Norberto Peets was arrested and then falsely identified as having played a role in a shooting that had previously occurred in the Bronx. Peets was then victimized by Police officers who fabricated evidence, destroyed exonerating evidence, and gave false statements which lead to Mr. Peets conviction and sentence to 26 years in prison. Plaintiff names twenty three people in his lawsuit and the city of New York. Roles of the plaintiffs include police officers, and evidence analysts. Plaintiff alleges Malicious Prosecution, abuse of process, Intentional infliction of emotional distress, negligent infliction of emotional distress, and failure to intervene, among other claims.

Description: On August 18, 1995, an NYPD detective was killed during a robbery. A police investigation culminated in unreliable eyewitness identifications of plaintiff as being the shooter. While an eye witness was viewing photographs in a procedure conducted by Detective George Milian, the witness was equivocal when she passed upon plaintiff's picture. Despite being against protocol, Milian showed the witness plaintiff's photograph a second time. The witness' level of certainty artificially increased the second time. Although the witness identified other possible perpetrators, this exculpatory evidence was never recorded.
