Description: Plaintiff and his friends were in front of their friend's house when defendant officer approached, noticed an empty beer can in their vicinity, and said they would give everyone open container summonses. When Plaintiff questioned them, he was handcuffed, brought to the 83 Precinct, and charged with Dis Con, Resisting Arrest, OGA, and unlawful possession of marijuana, which were ACD'd.
