Conclusion Meanings:

'Substantiated': The alleged conduct occurred and it violated the rules. The NYPD has discretion over what, if any, discipline is imposed.
'Unsubstantiated': or 'Unable to Determine' - CCRB has fully investigated but could not affirmatively conclude both that the conduct occurred and that it broke the rules.

Garcia, Tonya vs City of New York, et al.
Case # 15CV05835, U.S. District Court - Southern District NY, August 26, 2015, ended July 6, 2016
$11,500 Settlement
Complaint
Description: On October 2, 2013 Plaintiff was lawfully in her home. She was awoken when she heard banging on her door. Shortly thereafter, between 5 and 6 police officers were shining a flashlight in her face demanding to know the location of her son. Plaintiff asked how the officers had gotten into her apartment and if they had a warrant. They did not have a warrant and claimed the door had been open. The door had perhaps been unlocked, but was not open. When the plaintiff asked for the defendant's badge numbers, they turned their badges around. Ultimately the defendants left the plaintiff's home.
