Description: The plaintiff was enjoying a barbecue with his friends when the defendant officers in plain clothes charged at him on the corner of the street, tackled the plaintiff, assaulted him, continued to beat him, handcuffed him, and transported him to the hospital for his injuries followed by the local precinct. The defendant officers claimed they saw the plaintiff sell narcotics although they didn't arrest the "buyer" and they searched and found nothing on the plaintiff. The plaintiff was charged with criminal possession of a controlled substance in the third degree. The charges were later dismissed.

Description: Plaintiff was with his sister when he was approached by defendant officer De La Rosa within a movie theater. The off-duty officer had instructed the plaintiff to "tone it down". The plaintiff, who has been found to be legally "disabled due to a mental condition" and is blind in one eye, left the movie theater voluntarily. Defendant Officer De la Rosa followed the plaintiff and activated the NYPD Emergency Service Unit. When plaintiff left the theater, he was met with fifteen officers.
