Description: On October 11, 2012, Plaintiff was walking to the subway at night when at least one individual in an unmarked car ordered him to stop. The car had no headlights on and no indication that it was a police vehicle. The officers did not identify themselves as such. The officers were pursuing Plaintiff on the basis he may have matched the description of a perpetrator who had fled a police traffic stop. Plaintiff felt threatened and began to run. Some officers exited the vehicle and chased Plaintiff on foot. The officers shot Plaintiff multiple times, without justification, including after Plaintiff was incapacitated.
