Description: On or about October 27, 2013, Plaintiff let his dog out of his house and into his enclosed backyard. The backyard is completely fenced in, the dog had never escaped from the backyard, and there was no way for the dog to escape from there. Shortly thereafter, Plaintiff heard a gunshot. He went out and found two NYPD officers, names unknown, in his backyard. A police officer had discharged her weapon, shooting Plaintiff’s dog in the leg. The shooting was unjustified; Plaintiff’s dog had not left the backyard, had made no attempt to do so, and posed no threat to any person or property, including those of the NYPD officers.
