Description: On September 2, 2012, plaintiffs Luis Ortega, Alba Cuevas, Ana Gregorio, Evelyn Lugo, George Lugo, Edwin Avellanet, and Crystal Cruz were gathered at the home of Evelyn Lugo to celebrate Labor Day. Avellanet stepped outside to throw out a bag of garbage and was stopped and questioned by officers Charles Drobness and Ralph Conde, despite not committing a crime. The officers requested Avallenet's ID, and he refused after the officers refused to say why they needed it. The officers then grabbed him, and Avallenet pulled his arm away and escaped into the house. Description: Plaintiff was leaving a restaurant with a friend who was involved in an altercation with the restaurant's manager. The plaintiff was not involved. When walking to their car, the plaintiff's friend was pushed and arrested by the defendant. The defendant then asked the plaintiff for her identification but arrested her with tight handcuffs when she reached in her purse. She was searched and asked if she possessed drugs on her person. Nothing was found and she was transported to the 121th precinct where she charged with disorderly conduct. This charge was later dismissed and sealed.
