Description: On September 24, 2012, Plaintiff was operating his motor vehicle in Queens, N.Y. in a supermarket parking lot. A vehicle driven by NYPD Officer Milko Mejia pulled up behind Plaintiff and sounded its horn. Plaintiff moved his vehicle so Officer Mejia could pass. Officer Mejia sounded his horn again, so Plaintiff moved his vehicle again. Officer Mejia pulled his vehicle to the side of Plaintiff’s vehicle and stated “you fucking asshole.” Plaintiff replied that Officer Mejia was the “asshole.” Plaintiff tried to drive his vehicle to the front of the store to pick up his wife. Officer Mejia stopped his vehicle in front of Plaintiff’s, approached the Plaintiff, and cursed at him. Plaintiff exited his vehicle and ask...
