Description: On April 12, 2012, Plaintiff was a passenger in a van that was pulled over. Plaintiff exited the van as requested, and both the Plaintiff and the van were searched for illegal firearms, which were not found. Despite finding no firearms, Plaintiff was arrested for possession of a firearm, arraigned, and held at Rikers for four days. After multiple hearings, all charges were dismissed on December 5, 2012.

Description: On or about April 18, 2012, while Plaintiff was operating a minivan, he was pulled over by an unmarked police vehicle, allegedly because the vehicle had a taillight out. After that, Defendant police officers approached Plaintiff’s vehicle, screaming, “I know you have a gun in the vehicle.” Plaintiff denied having any firearm on his person or inside his vehicle.
