Description: On Aug 16, 2013 plaintiff was arrested by Sgt. James Williams, PO Nelson Acevedo, and John Does 1 - 5, in his building of residence. Police officers had entered the building due to some sort of disturbance on the floor below plaintiff’s dwelling. Plaintiff was concerned for the safety of his 2 children who had been playing downstairs in a courtyard in front of the building. Plaintiff exited his apartment solely with the peaceful intention of getting his children and escorting them back to his apartment.
