Description: The plaintiff was waiting for the elevator, en route to pick up food to eat, when he encountered the defendant along with other police officers. Plaintiff was handcuffed, patted down, and asked for his ID which was in his apartment. Officers entered the apartment to find the ID even though his domestic partner was present and offered to get it for them. The apartment was ransacked and the plaintiff was taken to a precinct. He was released with a Desk Appearance Ticket and later charged with criminal possession of marijuana and unlawful possession of marijuana. All charges were dismissed under Speedy Trial Provisions.
