Description: On March 10, 2015, plaintiff, who is incarcerated at VCBC, was at St Barnabas Hospital. He had walking pneumonia and was scheduled for surgery on his right hand, which at the time was numb. Detective Louis Pena and PO Jesus Sanchez arrived to pick up plaintiff, insisting he had a court date. The doctor informed the officers that plaintiff could not leave, but the officers insisted, and the plaintiff was forced to be released from the hospital with pneumonia and a numb hand. At court the judge gave the officers only a discretionary decision and not a ministerial duty to take the plaintiff back to hospital. As a result, plaintiff was sent back to VCBC while he was still sick.
