Complaint
Description: On July 9, 2019, Plaintiff was lawfully inside 314 Bay 20th Street, on the second floor, where he lives. Police officers only had a valid search warrant for the ground floor, which was being rented by another person. Nevertheless, officers searched Plaintiff's apartment and found a prescription bottle for Endocet, which Plaintiff had been prescribed by his primary care physician. The officers then arrested Plaintiff and falsely stated to the DA that Plaintiff had committed the crime of Criminal Possession of a controlled substance.
