Description: On August 4, 2019, Plaintiffs Tysheem Rivera, Jeremiah Perez, and Denzel Hart were lawfully present near Ellery Street and Marcy Avenue in Brooklyn, New York. They were stopped, detained, arrested, and searched by Sergeant Martin Gimenez, Officer William Campbell, and several unidentified NYPD officers without probably cause. The defendants wrongfully searched at least one interior compartment of Plaintiffs' vehicle without probable cause. Plaintiffs were detained at Housing PSA 3 as a result of the Individual Defendants’ actions, and were eventually released with Desk Appearance Tickets (“DAT”) charging them with CPL 221.10, a violation for which custodial arrest was not authorized under New York law.

Description: On June 4th, 2020, plaintiff was lawfully protesting when officers pulled into the crowd in a van and started grabbing people. Plaintiff was hit with a baton, shoved to the ground, arrested, and placed in tight zip tie handcuffs. Plaintiff waited while cuffed for two hours before being taken to the precinct, where she was unlawfully searched and detained.
