Description: On October 13, 2020, Plaintiffs (Matthew De La Cruz and Daniel Casanova) were lawfully present near the intersection of Bryant Avenue and 165th Street in Bronx New York. Officers Lauren Moriarty, Shield No. 14377 and John Does #1-6of the NYPD intentionally and willfully subjected plaintiffs to false arrest.
Plaintiffs were brought to an NYPD Precinct. Plaintiffs were brought to Bronx Central Booking to await arraignment. Eventually Plaintiffs were released without any charges being filed against them after the Bronx County District Attorney Declined to prosecute Plaintiff.

Description: On October 13, 2020, around 10:00 PM, near East 165th Street and Bryant Avenue, Bronx, Defendant Officers Mark Mobarek, Lauren Moriarty, John Doe, and John Roe approached Plaintiffs Hakeem Smith, Attim Walker, and Tarrell Austin for no reason and stopped, searched, grabbed, assaulted, battered, and detained them (stop and frisk). While in Defendant Officer's custody, Plaintiffs were subjected to a strip search and assault of his head, neck, back, body, and limbs. Plaintiffs were falsely arrested and incarcerated for over 24 hours prior to release, after arraignment at Bronx Criminal Court, and were then required to make numerous court appearances before their charges were terminated.

Description: On May 4, 2018 at around 10:25 PM, Defendants Officers Moriarty, Mesaris, Urena, and Alba entered Mr. Fincher's shelter dormitory in the Bronx while he was watching sports. Defendant Officers began questioning Mr. Fincher about his earlier whereabouts, and whether he had been drinking. They did not disclose the reason for their visit, and Mr. Fincher declined to answer their questions. Defendants Officers, now joined by FDNY/EMT Defendants Zucker and Guttman, then tightly handcuffed Mr. Fincher and transported him to Lincoln Hospital. At no point was Mr. Fincher ever placed under arrest. He also never resisted the Officers.
