Description: On July 22, 2013, as plaintiff was walking along a street, he yelled out to a friend. Defendant Officer Rosa, who was patrolling the area with defendant Lopez, overheard plaintiff and retorted with a homophobic comment. Defendant Rosa directed him to walk away, to which plaintiff replied that he lived in a different direction. Defendant Rosa grabbed him by the arm and Defendant Lopez maced plaintiff. Rosa proceeded to physically strike and handcuff plaintiff. Plaintiff was transported to the 42nd precinct and put in a cell.
