Description: On October 4, 2013, Plaintiff was driving his car on Linden Boulevard in Queens, NY, when without probable cause or reasonable suspicion, he was stopped by Defendant police officers and held at that location for about 30 minutes. Plaintiff was informed that he was pulled over because a single air freshener was hanging from his rear-view mirror, which obstructed the Plaintiffs view. After about 30 minutes, PO Brites asked Plaintiff to walk towards the police vehicle so he could explain what was going on. PO Brites handcuffed Plaintiff and told Plaintiff he had a warrant for his arrest, while in reality no warrant for arrest existed.
