Description: On October 12, 2014, Plaintiff was arrested by Officer Linhong Li and an identified officer for smoking a cigarette while waiting on a subway platform. Plaintiff was taken to the precinct where he was under the supervision of Officer Li and Officer Carlos Fermin. While there, Officer Fermin punched plaintiff and knocked him unconscious. He woke up the next morning handcuffed to a bed in the hospital with a fractured jaw, nose, a black eye, and swelling on the head and face. Officer Li was present during the assault. The unidentified officer assigned to plaintiff at the hospital told him that he had "messed with the wrong officer." Plaintiff was then taken to booking and charged with disorderly conduct. Description: On November 3, 2013, plaintiff was a passenger on the subway, heading home, dressed up as a Halloween character with a toy gun. An unknown person called the police claiming plaintiff had a gun. Defendants Fermin and Stahl stormed the subway car which plaintiff was on, yanked plaintiff off the car and onto the subway platform. Plaintiff was thrown face-first onto the platform, and had defendant's knees on his shoulder blades. Plaintiff was handcuffed. Other defendant officers arrived and kicked plaintiff in his face. Another defendant pressed his knees onto plaintiff's face. Plaintiff was transported to District 3 where he requested medical attention for his injuries, but his pleas were ignored for several hours...
