Description: On October 12, 2014, Plaintiff was arrested by Officer Linhong Li and an identified officer for smoking a cigarette while waiting on a subway platform. Plaintiff was taken to the precinct where he was under the supervision of Officer Li and Officer Carlos Fermin. While there, Officer Fermin punched plaintiff and knocked him unconscious. He woke up the next morning handcuffed to a bed in the hospital with a fractured jaw, nose, a black eye, and swelling on the head and face. Officer Li was present during the assault. Description: On November 3, 2013, plaintiff was a passenger on the subway, heading home, dressed up as a Halloween character with a toy gun. An unknown person called the police claiming plaintiff had a gun. Defendants Fermin and Stahl stormed the subway car which plaintiff was on, yanked plaintiff off the car and onto the subway platform.
