Description: On October 31, 2012, in the aftermath of Super Storm Sandy, plaintiff was driving a car on 96th Street, looking for a gas station. Plaintiff saw a gas station on 96th Street and pulled into the station. After parking her vehicle, Plaintiff asked if there was a line to purchase fuel, and was told that there was. Defendant approached plaintiff and instructed her to move her vehicle because she was not on line to purchase fuel. Plaintiff complied. Plaintiff drove her vehicle to the back of the line for fuel.
