Description: On November 4, 2009, plaintiff was arrested by Defendant officer Michael Sullivan on second degree Burglary and related offences with no probable cause. Prior to the above on December 15, 2004, plaintiff had been sentenced to 78 months in prison for possession of a weapon. On January 5, 2007 plaintiff submitted a DNA sample and was released on September 19, 2008. On November 21, 2008 plaintiff was sentended to 17 years in prison. In December 2008 he was admitteed prompting second DNA sample being taken. There was a 34 month delay in charging the plaintiff causing pre-accusation delay without any justification. On March 3, 2010, the DA office charged plaintiff. Plaintiff pled not guilty on March 18, 2010. Assi...
