Description: On April 17, 2012, Plaintiff, a pregnant woman, was in a Bronx subway station with her husband and one-year-old daughter. Plaintiff purchased a metro card from the machine. She then swiped said card through the turnstile so that her husband could enter via the gate with their stroller and one-year-old daughter. Plaintiff then swiped her card a second time and entered through the turnstile herself. At this point, Defendant officer Warren approached Plaintiff’s husband and asked him whether he had paid for entry. Plaintiff explained that she swiped him in so that he could enter with their stroller.
