Description: On January 9, 2014, at approximately 10:00 a.m., plaintiff was attending a job interview at the NYC Police Traffic Enforcement office. While filling out various interview-related paperwork, he was asked several times by PO Jonathan Penny if he knew a person named "Charles Deets." Plaintiff repeatedly denying any connection to this individual. Eventually, PO Penny arrested plaintiff because he believed to be "Charles Deets", who had an outstanding warrant out for his arrest. Officers James Gasiorek and Michael Daly were aware of the wrongful arrest but failed to intervene. Plaintiff was detained for approximately five hours, then brought to Manhattan criminal court, where he was released from custody.
