Description: On October 27, 2006, a man by the name of Juan Hernandez had been held up at knifepoint and had his gold chain stolen. Mr. Hernandez described the perpetrator as being 5'6" and average build. Plaintiff Sebastian Delamota is 6'2" and at the time of his arrest weighed 160 lb. The victim of the robbery stated that at the time of the attack, the perpetrator held a knife in his right hand while simultaneously snatching a chain from his neck with his left hand. At the time of the robbery, plaintiff did not have the use of his left hand as it hung limply at his side as a result of nerve damage.
