Description: On July 17, 2018, Plaintiff Jose Rivera was on a NYC MTA subway train where he was playing music from a portable speaker at a reasonable volume. Also on the train were several NYPD Officers - Officer Jose Acevedo and four unidentified officers. Defendants confronted Plaintiff about his music and ordered him to depart the train, which Plaintiff did. Defendants then issued Plaintiff a summons and took his portable speaker. Plaintiff Rivera called 911 to report the theft of his speaker by the 5 NYPD Officers, stating that he wished to file a police report against the officers. Plaintiff Rivera was transferred to IAB.
