Plaintiff stopped to complain to other defendant officers who kicked him off his motorcycle and began to physically assault him and spray mace in his face. Description: On August 28, 2012 at approximately 9:00pm, plaintiff ADOM MARTIN, while visiting his aunt and uncle who reside at 131 St. Nicholas Avenue, was stopped by NYPD officer BRIANNE VERGANO in the park adjacent to 131 St. Nicholas Avenue. Although plaintiff's aunt and uncle were present and explained to Officer VERGANO that their nephew was visiting them, Officer VERGANO arrested plaintiff and falsely informed employees of the District Attorney's office that plaintiff had been observed trespassing. Plaintiff was taken to Central Booking, arraigned and then released after 36-hours in custody. Following three court appearances, the charges against the plaintiff were dismissed.
