Description: On February 12, 2014, plaintiff Edelmin Avila-Alvarez was lawfully present as a patron at a store when Officer Vincent DeSantis, who was off duty at the time, forcibly dragged plaintiff out of the store and threw him to the ground. Officer DeSantis then proceeded to stand on plaintiff's left hand for an excessive period of time.
