Description: On October 23, 2007, at approximately 1:00am, Plaintiff and her husband took their 2-month-old to the ER after she went limp while feeding. Prior to this, the baby had spent her first few days in the NICU and also suffered from genetic heart and bone issues. After initial assessment, the matter was diagnosed as SIDS, since the baby had no external trauma or signs of internal bleeding/hemmorrhaging. Later this day, an opthamology report and CT scan showed hemorrhaging in her eyes, evidence of a sinus infection, and most significantly a skull fracture—though the data suggested this was an old fracture. By evening, the case had been assigned to the NYPD on suspicions of child abuse. By the evening, Plaintiff and h...
