Description: Plaintiff was a passenger in a car that was circling a restaurant while one passenger was grabbing food inside. When passenger returned, officer pulled over car, searched it, and found a gun in the other passenger's purse. Plaintiff was arrested with all passengers and taken to 37th precinct. Charged Plaintiff with 265.03(3) Criminal Possession of a Weapon in the Second Degree. Officer Kailer planted evidence to justify his stop and lied about how he found the gun to a grand jury. Plaintiff was convicted then appealed and the charges were abandon, after 5 years in jail.
