Description: On January 13, 2013 at approximately 10pm, Plaintiff's wife was driving a vehicle while Plaintiff was seated in the back seat of the vehicle holding a table that they were transporting. Defendant Police Officers John Does 1 and 2 stopped the vehicle and checked Plaintiff's wife's license. Sergeant Manuel Fleites, an NYPD supervisor wearing plainclothes, arrived and falsely claimed that Plaintiff had been driving the vehicle. Sergeant Fleites forcibly removed Plaintiff from the vehicle and administered a breathalyzer, which showed 0.0% alcohol. Description: On May 14, 2012 plaintiff Jose Cespedes was having drinks when an argument ensues between the plaintiff and friends. When the police arrive on the scene they arrested and assaulted the plaintiff, resulting in a hospital visit for several bruised/fractured ribs. He has a permanent scar on his wrist from the handcuffs. The plaintiff was incarcerated for approximately 48 hours.
