Description: Officers approached Plaintiff in a deli, asked for ID, told him there was a warrant for his arrest, handcuffed him, and brought him to the 90th Precinct, where he was told there was no warrant for his arrest. Instead, there was an i-card from the 79th Precinct. Defendant Officer Tischler told Plaintiff that he was identified as a witness to a shooting and Plaintiff invoked his right to counsel. Plaintiff was then kept at the precinct overnight, brought to Central Booking, and then released without arraignment because the DA declined to prosecute the case.

Defendant Officers handcuffed Plaintiff excessively tight, took him to the 79th precinct, where the warrant turned out to be an I-Card by Detective Moody. After Plaintiff's alibi for the incident which he was suspected of checked out, the detective let him leave.

Description: July 10, 2013 , Plaintiff went to 79th precinct after learning that Defendant Moddy wanted to speak with him about a shooting that occurred on June 22, 2013. Plaintiff was placed in interrogation room and locked inside. Defendants lacked probable cause or reasonable suspicion to believe plaintiff had been involved in illegal activity. Defendants acted maliciously and with intent to injure plaintiff.
