Description: On March 14, 2015, at approximately 1:40 AM near 10th Avenue and 214th street in Manhattan, Plaintiff Miguel Nolasco exited a restaurant where he was eating with an associate. As he exited plaintiff observed defendants P.O. Soto and P.O. Zabala in a marked police vehicle staring directly at him. As plaintiff began to drive away in his car, he heard a siren and saw that the defendant officers were signaling for him to pull over. Plaintiff pulled over and the officers approached. Officer Soto asked for plaintiff's license and registration, and then asked him to leave the car and do a breathalyzer test, to which plaintiff consented.
